Any visit to the Site or any purchase of one of our products/services implies acceptance of these Conditions.
PART I – ONLINE SALES
ARTICLE 1: Purpose
These GTC are entered into between:
SAS MAXIME DUBOIS, a company with share capital of €100,000, having its registered office at 120 rue de l’Ile Napoléon, 68170 RIXHEIM, registered with the Mulhouse Trade and Companies Register under SIRET number 819 793 720 00015.
Hereinafter referred to as SAS MAXIME DUBOIS or the Service Provider,
On the one hand,
And
Any customer of the Site www.maxime-dubois.fr,
Hereinafter referred to as the Customer or the User,
On the other hand.
ARTICLE 2 – Terms and conditions of online sales
These Conditions are intended to define the terms and conditions for the sale of the products/services presented on the Site between SAS MAXIME DUBOIS and the Customer.
SAS MAXIME DUBOIS offers the following for sale through this Site:
- Sale of hair products and accessories
- Sale of hair prostheses, wigs, fringes, and volumizers.
ARTICLE 3 – Acceptance of the GTC
Before concluding the sales contract, the Customer acknowledges having read, understood and accepted these General Terms and Conditions of Sale, which is confirmed by checking the box “I have read and unconditionally accept the general terms and conditions of sale” when placing the order.
The Customer further declares that purchases of products on the Site are made solely for personal use and in no event for commercial purposes, in particular for resale.
The Customer undertakes to comply with the GTC throughout the performance of the sales contract.
The Customer declares that they have full legal capacity enabling them to commit themselves under these GTC.
ARTICLE 4 – Availability of products
Offers of products and items are valid as long as the products are visible and selectable on the Site, and within the limit of available stocks.
When preparing the order, SAS MAXIME DUBOIS verifies the availability of the product(s) ordered.
In the event of temporary unavailability of a product, the Service Provider undertakes to:
- Either send the Customer the order, with the unavailable items deducted, specifying the additional delivery time for these items.
- Or cancel all or part of the order.
ARTICLE 5 – Order
Any order of products on the Site takes place in several stages:
- Selection of products / Customization for eligible products
- Validation of the basket
- Identification of the Customer (surname, first name, personal address, delivery address, telephone number…)
- Summary and validation of the order by the Customer
- Payment
ARTICLE 6 – Prices
The prices of the products presented on the Site are expressed in Euros and are inclusive of all taxes in force on the day of the order.
They may be subject to discounts during occasional promotional operations.
The prices displayed do not include delivery charges in force on the day of the order, unless otherwise stated.
SAS MAXIME DUBOIS may change its prices at any time but undertakes to apply the prices in force at the time the Customer validates the order.
ARTICLE 7 – Payment
The Customer must pay for their purchases by bank card via a trusted provider accessible at the time of basket validation.
The technical means implemented on the Site ensure the security of orders and payments.
SAS MAXIME DUBOIS reserves the right to refuse to make a delivery or honour an order from a Customer who has not paid all or part of a previous order.
Furthermore, in the event of non-payment occurring after delivery of the ordered products, SAS MAXIME DUBOIS will send the Customer a request for immediate payment, without prejudice to any legal proceedings if necessary.
ARTICLE 8 – Delivery
Orders placed by the Customer are delivered to the address indicated by the Customer when placing the order.
The standard delivery method chosen by SAS MAXIME DUBOIS is delivery to a relay point (hair products and cosmetics). For the shipment of hair prostheses, wigs, fringes and volumizers, delivery to the mailbox or against signature is preferred.
The delivery charges are as follows: a flat-rate contribution to shipping costs of €5 payable by the Customer.
From €100 incl. VAT of purchases, shipping costs are free (relay point delivery). For the purchase of a hair prosthesis, wig, fringe and volumizers, shipping costs are free (mailbox/signature delivery).
SAS MAXIME DUBOIS undertakes to dispatch, unless a different deadline is indicated or in the event of force majeure:
- For hair products and cosmetics: the products are dispatched within a maximum period of 7 days from validation and full payment of the order (transport time by the carrier excluded),
- For hair prostheses, wigs, fringes and volumizers:
- The products are sent within a maximum period of 3 weeks for ready-to-wear products (transport time by the carrier excluded),
- The products are sent within a maximum period of 3 months for made-to-measure products (transport time by the carrier excluded).
In the event of a prolonged delay, the Customer shall notify SAS MAXIME DUBOIS as soon as possible by email at maxime.dubois68170@gmail.com.
ARTICLE 9 – Retention of title clause
The products remain the property of SAS MAXIME DUBOIS until full payment of the order has been received.
However, from the moment the Customer receives the order, the risks relating to the goods delivered are transferred to the Customer.
ARTICLE 10 – Right of withdrawal – Reminder of the legal framework applicable to distance selling
In accordance with Articles L221-18 et seq. of the French Consumer Code, a Customer who has received items that do not provide full satisfaction has a period of 14 days to exercise their right of withdrawal from the date of receipt of the order, without having to state reasons for their decision or bear any costs other than those necessary to return the goods to the premises of SAS MAXIME DUBOIS.
By way of exception, Article L.221-28 of the French Consumer Code provides that the right of withdrawal may not be exercised for contracts concerning: […]
- 3° The supply of goods made to the consumer’s specifications or clearly personalized,
- 4° The supply of goods liable to deteriorate or expire rapidly,
- 5° The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
WE REMIND YOU that in the context of the sale of hair prostheses, wigs, fringes and volumizers, the Customer asks SAS MAXIME DUBOIS to personalize the model (colour, cut, styling, length, texture, etc.), so that each model produced is UNIQUE.
CONSEQUENTLY, once the order has been validated and paid for, it is firm and final and is not subject to the statutory withdrawal period. NO RETURN IS POSSIBLE ON THIS GROUND.
ARTICLE 11 – Return of products
1° For products eligible for the right of withdrawal
To exercise the right of withdrawal, the Customer shall send an email to: maxime.dubois68170@gmail.com. The Customer must expressly state their wish to withdraw. On this occasion, the Customer shall specify their surname, first name, address, order number and the items concerned.
SAS MAXIME DUBOIS will inform the Customer by return email of the procedure to be followed for the return and refund.
Excluded from this right of withdrawal are orders for hair prostheses, wigs, fringes and volumizers as referred to in the previous article. The same applies to hair products which, once unsealed, cannot be returned for reasons of hygiene or health protection.
In all cases, the cost of returning the goods remains the responsibility of the Customer in the event of withdrawal.
2° For non-compliant products
The Customer shall send an email to: maxime.dubois68170@gmail.com. The Customer shall expressly indicate the reason for the non-compliance (wrong products sent, etc.). On this occasion, the Customer shall specify their surname, first name, address, order number and the items concerned. A photo of the product(s) concerned by the request must be attached to the email.
SAS MAXIME DUBOIS will inform the Customer by return email of the procedure to be followed for the return, exchange or refund.
In this case, the costs of returning the goods and, where applicable, exchanging them shall be borne by SAS MAXIME DUBOIS.
ARTICLE 12 – Legal warranties
All products supplied by SAS MAXIME DUBOIS benefit from the legal guarantee of conformity provided for in Articles L. 217-4 et seq. of the French Consumer Code or the warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.
ARTICLE 13: Amendment of the general terms and conditions of use and sale
These general terms and conditions may be amended at any time by the Service Provider and are directly applicable as soon as they are published online.
ARTICLE 14 – Applicable law
French law shall apply to the general terms and conditions, without prejudice to the mandatory laws of the place of residence of the consumer User. The cancellation or invalidity of one of the clauses of these general terms and conditions shall not result in the nullity of the other clauses. Failing amicable resolution of a dispute arising between the parties, the French courts shall have sole jurisdiction to hear it, without prejudice to the jurisdictional privilege granted to consumers, in accordance with the provisions of Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of 12 December 2012.
ARTICLE 15 – Consumer mediator
As a consumer, if the Customer considers that their rights have been infringed, they may send their complaint to the following postal address: SAS MAXIME DUBOIS, 120 rue de l’Ile Napoléon 68170 RIXHEIM.
The Customer, when acting as a consumer within the meaning of the French Consumer Code or the provisions of European law, may, if they so wish, refer the matter to any mediator of their choice in order to resolve a possible dispute with the seller.
PART II – ONLINE APPOINTMENT BOOKINGS (Rixheim / Saint-Louis salon)
ARTICLE 1: Purpose
These general terms and conditions of use and sale (known as the “GTC” or “Conditions”) govern browsing on the website: www.maxime-dubois.fr (hereinafter the Site) and the provision by SAS MAXIME DUBOIS or SAS MLD COIFFURE (hereinafter collectively referred to as the “Service Provider”) of its booking services to any internet user or visitor to the Site (hereinafter referred to as the “User”).
The User is informed that for any online appointment booking made on the Site, they enter into a contract either with SAS MAXIME DUBOIS or with SAS MLD COIFFURE depending on the selected salon. Thus:
- For bookings at the Maxime DUBOIS hair salon in Rixheim, the User contracts with SAS MAXIME DUBOIS, located at 120 rue de l’Ile Napoléon 68170 RIXHEIM, SIREN 819 793 720,
- For online appointment bookings at the Maxime DUBOIS hair salon in Saint-Louis, the User contracts with SAS MLD COIFFURE, located at 3 rue de Mulhouse 68300 SAINT-LOUIS, SIREN 932 817 737.
ARTICLE 2: Access to services
The Site allows the User to book services from the Service Provider (online booking). The availability of this service does not constitute a firm commitment by the Service Provider, who may at any time restrict access to it as well as the scope of the services and functionalities offered, subject to honouring contracts previously concluded. The Site is accessible free of charge from any location to any User with internet access. All costs incurred by the User to access the service (computer equipment, software, internet connection, etc.) shall be borne by the User.
ARTICLE 3: Processing of personal data and Bloctel
Acceptance of the data processing policy by the User is necessary for the use of the services. As the Service Provider may collect the Customer’s telephone number and email address, it informs the Customer that they have the right to register free of charge on the BLOCTEL telephone canvassing opt-out list in order no longer to be contacted by telephone for marketing purposes.
ARTICLE 4 – Acceptance of the GTC
Before concluding the booking, the Customer acknowledges having read, understood and accepted these General Terms and Conditions of Sale.
The Customer undertakes to comply with the GTC throughout the performance of the sales contract.
The Customer declares that they have full legal capacity enabling them to commit themselves under these GTC.
Any booking made online constitutes express acceptance of these general terms and conditions of use and sale.
ARTICLE 5: Online booking (cancellation fees or missed appointments, and payments)
Online booking allows the User to book a service on a specific date and at a specific time with the Service Provider among those offered on the Site. It is the User’s responsibility to ensure that the correct service is selected, adapted to the length of their hair and with the desired staff member. The Service Provider cannot be held liable for an error made when booking an appointment online.
The online payment function allows the User to provide their payment method details to the secure payment provider designated by the Service Provider. Services offered for online booking require payment of a deposit of 50% of the amount of the booked service. This amount will be debited via our provider PLANITY / STRIPE.
The balance of the service shall be paid on the day of the appointment, the choice of payment method remaining at the discretion of the Customer (card, cash or cheque).
Please note in the event of non-attendance at the appointment: the User who makes a booking and does not attend the scheduled appointment with the Service Provider is informed that all or part of the amount of the service will be retained and/or charged as cancellation fees by the Service Provider, using the payment information provided by the User. The amounts of the fees and cancellation terms are indicated when the online booking is made, before final confirmation by the User. Acceptance of these fees by the User is necessary for use of the services. As of 1 January 2026, these fees amount to 50% of the service price (the amount of the deposit).
Likewise, the User may cancel their booking free of charge up to 48 hours before the appointment. The amount paid online as a deposit will then be refunded by the Service Provider. After this 48-hour period, the User is informed that all or part of the amount of the service will be retained and/or charged as cancellation fees by the Service Provider, using the payment information provided by the User. The amounts of the fees and cancellation terms are indicated when the online booking is made, before final confirmation by the User. Acceptance of these fees by the User is necessary for use of the services. As of 1 January 2026, these fees amount to 50% of the service price (the amount of the deposit).
As a reminder, any booking made online constitutes express acceptance of these general terms and conditions of use and sale.
ARTICLE 6: Amendment of the general terms and conditions of use and sale
These general terms and conditions may be amended at any time by the Service Provider and are directly applicable as soon as they are published online.
ARTICLE 7: After-sales service – Mediation
The Service Provider may be contacted at any time at the following postal address:
For the Rixheim salon: SAS MAXIME DUBOIS – 120 rue de l’Ile Napoléon – 68170 RIXHEIM.
For the Saint-Louis salon: SAS MLD COIFFURE – 3 rue de Mulhouse 68300 SAINT-LOUIS.
The User, when acting as a consumer within the meaning of the French Consumer Code or the provisions of European law, may, if they so wish, refer the matter to any mediator of their choice in order to resolve a possible dispute with the seller.
ARTICLE 8: Applicable law and competent jurisdiction
French law shall apply to the general terms and conditions, without prejudice to the mandatory laws of the place of residence of the consumer User. The cancellation or invalidity of one of the clauses of these general terms and conditions shall not result in the nullity of the other clauses. Failing amicable resolution of a dispute arising between the parties, the French courts shall have sole jurisdiction to hear it, without prejudice to the jurisdictional privilege granted to consumers, in accordance with the provisions of Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of 12 December 2012.
PART III: Miscellaneous conditions
ARTICLE 1: Intellectual property
The trademarks, logos, signs and all content of the module (texts, images, files, codes, configurator, software, etc.) are protected by the French Intellectual Property Code and more particularly by copyright law. The User must request prior authorization from SAS MAXIME DUBOIS for any reproduction, publication or copying of the various contents. Any use for commercial and advertising purposes is strictly prohibited. Any total or partial representation of these elements, by any means whatsoever, without the express authorization of SAS MAXIME DUBOIS, would constitute an infringement punishable under Article L.335-2 et seq. of the French Intellectual Property Code. It is recalled, in accordance with Article L.122-5 of the French Intellectual Property Code, that the User who reproduces, copies or publishes protected content must cite the author and the source.
ARTICLE 2: Liability
The User is responsible for the use they make of the services offered by the Service Provider, in particular for any fraudulent or unlawful use of means of payment. The Service Provider cannot be held liable for any virus or malicious program that may infect the User’s computer or any computer equipment resulting from use of, access to, or downloading from the Site. The User acknowledges and accepts that the Internet network may involve risks related to the absence of protection of certain data against misappropriation and risks of contamination by a malicious program. The Service Provider cannot therefore be held liable for any loss or alteration of data, any loss of profit, turnover, opportunity or time, or any indirect damage, whether such loss or damage is due to negligence or any other cause. The Service Provider cannot be held liable to the User in the event of unavailability of the functions offered on the Site. The liability of the Service Provider cannot be engaged in the event of force majeure or the unforeseeable and insurmountable act of a third party.
ARTICLE 3: Hyperlinks
Hyperlinks may be present on the Site. The User is informed that by clicking on these links, they will leave the Site. The latter has no control over the web pages to which these links lead and cannot under any circumstances be held responsible for their content.
